The Trouble With Kratom: What We Can’t Tell You

There are many who enjoy kratom on a regular basis but don’t know much about how it actually works. There are others who are curious about trying kratom for the first time, but they can’t find enough reliable information online to really feel confident using it. Why is it that this uncertainty exists around the subject of kratom?

Unfortunately, legality is a big part of why sellers like us cannot say more about kratom when we are marketing our products. While we know a lot about this botanical, how it works, and what it could do for you, we could be breaking the law if we weren’t careful about how we describe and market our product.

Understanding why things are set up like this can be confusing, but the situation doesn’t have to stay like this forever! That’s right; it is possible for this situation to change if the right types of time, money, and effort are put into the world.

Today, we’ll be sharing what we know about the rules that prevent kratom companies like us from discussing certain topics with consumers. Then, we’ll let you know what YOU can do to help this problem improve in the future of the kratom industry.

How The FDA Regulates “Claims” Marketing

There are tons of different rules and regulations that the Food and Drug Administration uses to help protect consumers in America from mislabeled or otherwise dangerous products. Like any other seller on the market, we are liable to follow these regulations. 

Generally speaking, the FDA recognizes two types of claims:

  • • Health claims
  • • Structure/function claims

What Are Health Claims?

Health claims are a type of claim that specifically links a substance to a disease or health-related condition. Health claims can only be used for drugs that have been approved by the FDA to treat diseases. 

In this type of claim, the product is marketed as a specific solution to a problem. For example, allergy eye drops are specifically formulated to contain some ingredients which soothe itchy eyes and are marketed as such. This would fall into the category of a health claim, and the claim would need to be pre-approved by the FDA before any marketing begins.

Saying that eating carrots helps maintain your sense of sight, however, would not be considered a health claim because it is not targeting a specific health condition. This is considered a structure/function claim.

What Are Structure/Function Claims?

The other type of claims that the FDA deals with frequently are the structure/function claims. These claims are more general and talk about how nutrients and ingredients can change or affects the body’s functions.

For example, saying that vitamin A helps improve vision is a structure/function claim.

These types of claims can be added to supplements in the US without any FDA pre-approval, but the information must be passed to the FDA within 30 days. Additionally, you must have substantial evidence to support your claim. Finally, disclaimers must be added to all packaging to let customers know that the FDA did not review the claims.

The Trouble With Kratom

Now that you have a little bit of background knowledge about how the FDA deals with drug and supplement related approvals, let’s talk about the trouble with kratom.

Kratom is not an FDA-approved drug, therefore it cannot use any health claims. What’s tricky is that the FDA also does not consider kratom to be a supplement, therefore structure/function claims are off limits too.

Vendors typically sell kratom as a dietary ingredient, a supplement, or a food, though the specific classification has changed over time and will likely continue to change into the future.

Health & Structure/Function Claims Do Not Apply

While you can use health claims or structure/function claims to market some drugs and supplements, the same cannot be said about kratom.

In the case of health claims, there is no FDA-supported evidence that kratom has any positive effects at this time. For that reason, the FDA will not pre-approve any statements about kratom to be used as health claims. 

In the case of kratom, structure/function claims are also prohibited. While the base compound found in kratom (mitragynine) has been shown to have effects on the body, there is not yet a solid baseline measurement for the body’s natural level. This means that comparing the function of kratom to the body’s normal function is impossible.

And for that reason, we as vendors become severely limited in what we can and cannot say about kratom!

Why We Think This Needs To Be Changed

Ideally, the day will come when we can legally describe the effects that kratom may have, like many other botanicals currently marketed as supplements. Unfortunately, there are a lot of barriers to making this happen.

Many vendors have lied, sold dangerous product, or otherwise caused problems within the kratom community over the years. Due to their irresponsibility, reliable vendors like us have to suffer from the negative perception that both members of the general public and the FDA have about kratom.

If the perception of kratom never changes, the bad vendors will never be held accountable, and consumers will be continually put at risk of buying a poorly made, unregulated product.

While there are vendors like us and organizations like the American Kratom Association fighting for our rights to use kratom safely and freely, we can’t do it alone. To truly have an impact on how the kratom industry grows and changes in the future, we need all kratom lovers to join us in pushing back against negative perception.

Thailand: The Introduction

The first thing that you should get to know are the basics!

There are currently more than 68 million people living in Thailand. While there are big cities like Bangkok and Chiang Mai to visit, the 76 regions of Thailand are also dotted with amazing villages and mountain towns that are still very small in size. Like any other country, you can find a variety of types of cities and towns.

The currency currently used in Thailand is the Thai Baht. One USD is equal to about 30 Thai Baht, so you will need to do some conversions on the fly while you are shopping there if you want to know how much something costs.

Finally, Thailand is the 50th largest country in the world. It is just a little bit larger than Spain. Thailand’s weather and environment differ quite a bit in most northern regions when compared to the southern, tropical areas. Depending on what time of year you visit, you may want to consider which region will be most enjoyable to be in.

Visiting Thailand: Timing & Budget

Since we’re talking about the weather, let’s get a bit more in detail about what time of year is the best time of year to visit and how much you can expect to spend when vacationing in Thailand.

Timing

Generally speaking, you will probably want to visit during the winter months. This is because you can avoid the hottest and the wettest weather if you come between December and March!

If you visit between May and October, you’re likely to deal with rainy conditions for a large portion of your trip. Between March and May, the temperature skyrockets into uncomfortable ranges. 

For that reason, visiting during the cool season of November to February is usually a better choice to avoid the worst types of weather that happen in Thailand. If you can’t visit in that range, however, don’t worry too much! Thailand is beautiful at any time of year; just make sure that you are prepared to handle the weather conditions that you will find there.

Budget

Another factor that you will want to consider is your budget. How much are you prepared or expecting to spend while in Thailand?

Depending on the type of accommodations that you want to stay in, you’ll need to budget anywhere from $6 to $40. Many hotels cost less than $40 per night unless you want to stay in very high-end suites.

As far as food goes, eating like a local can save you a bunch! Street vendors sell complete meals for less than $2 a meal, and eating at small restaurants usually costs between $5 and $7 for each meal. High-end restaurants come in around $15 to $25 in most cases, and that is still very affordable when compared to other tourist destinations.

Types of Areas To Visit

When people head to Thailand, there are a number of different types of things that they tend to do. We’ve outlined a few different types of trips that you might want to experience while in Thailand!

The Island Adventurer

Many people head to Thailand to relax on a beach, and that can definitely be accomplished in the southern regions of Thailand! Here, you can hit up coastal resorts, island hop to smaller islands, or just hang out on the first beach you find.

Like the early days of CBD oil and similar products, figuring out the best ways to talk about kratom so that you can accurately and honestly describe your experiences can be hard. What can you say even when the legal status of kratom can be a bit hard to describe?

Tip #1: Get Educated

Tip #2: Don’t Push The Limits

Remember that not everyone is going to be interested in what you’ve gained from kratom or what you have to offer. And that’s okay!

Even people who trust their friends and family often need more solid proof of something existing or working before they believe it. This is the case for many different issues, and the same can be said for kratom.

If you’re talking about someone and they have a lot of questions about how to use kratom or how it works, give some information about how it figures into your life. Sharing our stories can be a powerful way to connect with other people and to pass along important insights through personal experience.

But, don’t be surprised if someone is looking for more solid evidence than anecdotal info. In that case, you might say:

  • • “You seem really interested. Can I recommend a blog with great articles that can help you get a better understanding of kratom?”
  • • “Do you want me to send you the kratom advocacy group so you can learn more?”
  • • “Here’s a reputable online vendor; why don’t you check out the info on their site?”
  • • “Let’s go to my favorite kratom shop together sometime; you can learn a lot from the people there, too.”

It’s almost always a good idea to offer someone more than just stories when you are teaching them about something outside of their comfort zone. Knowledge will help them feel more secure in their interest, so setting them up with a way to get more of that knowledge at their own pace is one of the best things that you can do for someone.

What Is Kava? All About “Nature’s Relaxer”

With the return of natural dietary supplements and the rise of products like kratom and CBD, it can be hard to keep up with all of the different offerings that are available today.

Additionally, we also aim to educate consumers that are curious about the history, power, and status of each of the items that we keep in stock. 

Many of our consumers don’t yet know much about kava kava. Have you heard of kava before? This natural root is a bit of a mystery to some, but it’s worth taking the time to learn a little bit more about it!

What Is Kava?

Let’s start with the basics!

Kava is an extract that is taken from the roots of a plant known as Piper methysticum. This plant is also known as “awa,” “ava pepper,” “intoxicating pepper,” or “long pepper.” While the plant has many names, the extracts that are taken from all of these plants have similar effects when used as a supplement.

The kava plant is a member of the pepper family, and that is why there are some names for this plant that include the word pepper. If you look at the leaves of the plant, you will see that they are similar in shape and size to a bell pepper plant. 

Where Does Kava Come From?

The plant that kava originates from typically grows in tropical regions. In particular, kava can be found in the Hawaiian islands, the South Pacific, and in other regions like Indonesia and Thailand. If it has tropical weather and a relatively long rainy season, there is a chance that kava grows in that region.

How Was Kava Traditionally Used?

Many believe that the original usage of kava originated in the South Pacific. The word Kava actually comes from a Polynesian word. This word, “awa,” can be translated to bitter. 

Traditionally, kava is brewed into a drink. This drink is mildly intoxicating, and it is usually consumed socially. In the same way that western societies drink alcohol, South Pacific Islanders drink kava!

What Benefits Does Kava Offer?

While kava cannot be treat any conditions, there are a number of anecdotal stories about how it can benefit a user. We’ve found that many consumers take kava in hopes of benefiting from its relaxing properties, often finding that it helps them deal with stress or get a better night’s sleep.

Beyond these issues, some people rub kava on their skin to improve skin conditions while others use it as a mouthwash when they are dealing with things like canker sores in their mouth.

Again, kava is not FDA approved to treat any of these conditions, and we do not sell kava as a way to treat these issues. Instead, we suggest you use it as a dietary supplement for your overall health at your own discretion.

Today, we simply aim to share how and why many consumers use this botanical.

How Is Kava Taken?

When kava is used, the parts of the plant that are mostly used are the root and the underground stem. Kava is often divided into noble and non-noble cultivars, with only noble cultivars being appropriate to consume. These are used to prepare drinks, especially for traditional use in South Pacific cultures. These parts of the plant can also be ground and made into capsules, tablets, or straight powder extracts.

Typically, kava is consumed in a beverage form, but it can also be taken more directly in powder or capsule form. For some benefits, there are users that report rubbing a kava paste on their skin to help deal with dry skin and other issues. Finally, some people use kava as a mouthwash.

How Does Kava Work?

Several studies have been done on kava and its active ingredients, called kavalactones. Scientists have discovered at least 18 kavalactones in kava plants and have studied their pharmacology (or how they act and react in the human body). Most studies indicate that kava has relaxing effects. Many kava users agree that kava affects the brain and central nervous system. Kavalatones are thought to bind with receptors in the nervous system to causing the observed effects.

Is Kava Legal?

While there have been health concerns raised by the FDA about kava in a few specific circumstances, kava remains legal in the USA. The substance has been banned in some European countries, and Canada also forbids its sale. 

Pacific Islands that export kava took a hit to their economies when this happened, but the US still permits the import and use of kava as a dietary supplement. Of course, it cannot be sold as a medicinal herb or remedy. 

The main concerns that have been cited over time about kava are similar to the problems caused by alcohol. In particular, there has been some concern that too much kava usage can lead to liver problems, but further studies are needed to understand this risk and incidences are generally rare.

Kava is quite popular in the United States and is marketed as an herbal supplement. In some cities, there are even kava bars where consumers can gather to socialize without alcohol.

Kratom has become a very popular botanical, but there’s a lot that most kratom lovers do not know about this little plant. For instance, many don’t know that kratom is actually a tree that can grow very tall!

When you get a lot from something like kratom, it’s a good idea to learn more about what that botanical really is, where it comes from, and what the world has to say about it. At least that’s what we believe here at Phytoextractum!

Becoming more educated about kratom, however, can be overwhelming for those who don’t know where to begin their research. And that’s why we’ve created this series of blogs to help our customers learn more about the items that we are so proud to offer!

A Brief History of Kratom’s Origins

Kratom, also known as Mitragyna speciosa, is a tropical tree that has existed for thousands of years. This tree is related to coffee trees in a way, but the tree has very different characteristics and properties when compared to the coffee tree.

The kratom tree can be found natively grown in many Southeast Asian countries, particularly those with tropical climates:

  • • Thailand
  • • Malaysia
  • • Papua New Guinea
  • • Borneo
  • • Indonesia
  • • Myanmar

In these regions, locals have used the fresh leaves as a type of chew when grinding through hard labor. Additionally, a brewed version of kratom has been used in ritual ceremonies for hundreds of years as well.

As far as western history goes, there are European records which note the local usage of kratom from the 1800s and onward. The tree was first identified by Pieter Korthals in 1839, but it took until 1859 for a formal classification to be confirmed.

When you see kratom, it’s probably already in a capsule or ground up into a powder for easy consumption. If you walked into a forest of kratom trees, would you be able to recognize them? Our guess is no, and that’s okay!

Kratom trees are very tall. On average, they are around 50 feet tall. If they are growing in their preferred regions, however, they can tower to well over 80 feet!

Similar to other tropical trees, the leaves and bark have certain tropical characteristics:

  • • Smooth bark without many ridges
  • • Large leaves
  • • Leaves that appear waxy
  • • Leaves that are pointed at the tip
  • • Seemingly random brand pattern that helps the tree soak up as much sun as possible!

The leaves of kratom trees can be various shades of green, and the veins on the leaves will also change color depending on when in the growing season or life cycle of the tree they are harvested.

The specific weather patterns where the trees grow affect how they grow. In areas where the conditions are ideal (i.e., it’s always hot and humid like in Thailand), the M. speciosa tree will be huge and very tall because they need to compete with a lot of other plants for light.

In other areas (such as Indonesia), the weather changes throughout the year and can change how much growth the kratom tree goes through during the year.

Different Growing Locations

Depending on which type of conditions a tree grows in, the specific chemical makeup of the kratom tree and its leaves can change. This is how the first observable difference between strains of kratom was noticed, but these strains are now often named for the seeds’ area of origin rather than where the trees are grown.

Why is that?

Simply put, kratom trees have been made illegal in some areas where they are indigenous, such as Thailand. This means that Thai strain Kratom cannot be grown and exported from Thailand, but the Thai-style strains of kratom are still being grown in other regions with similar growing conditions.

What Are Kratom’s Active Alkaloids?

When browsing your favorite kratom websites, you’ve probably noticed that many vendors will list the percentages or amounts of mitragynine and 7-hydroxymitragynine that can be found in a specific type of Kratom. 

Have you ever thought about what these compounds are? Many people have, but others are still clueless about the how kratom works.

These compounds are known as active alkaloids, and they are the power behind the kratom!

There are a lot of different alkaloids found in kratom, but the two that have been studied most extensively are mitragynine and 7-hydroxymitragynine. At this time, the research that has been done on these substances specifically is relatively limited. 

Still, we know that these chemical structures do a few things:

  • • They interact with a specific type of receptors in the nervous system.
  • • When they interact with this receptor, they do not bond permanently.
  • • The temporary bond creates some effects in the body, and this is what kratom users experience.

We’re very excited for more research about kratom and how it truly works within the body to happen in the coming years as kratom’s popularity continues to rise!

Legal Status & Future Advocacy

At this time, kratom is not illegal in the US, but it is still a point of contention for the FDA. Due to a lot of widely circulated misinformation, there is a certain perception that kratom is dangerous. This is widely inaccurate, and that message is changing.

The American Kratom Associate is a kratom advocacy group that works hard to ensure that kratom consumers will be protected from unscrupulous vendors while also advocating for the legal status of Kratom at all turns.

They have even created a Good Manufacturing Practices Standards program for kratom vendors to ensure that consumers aren’t being sold bad products. If you want to help support the future of kratom, do your part and only buy from vendors who are willing to participate in this compliance program.
