What Changed in 2025–2026: A Timeline

Here’s a quick look at the most significant legislative developments over the past year. Green events represent wins for kratom access; red events represent new bans or restrictions; orange marks pending or mixed developments.

May 2025
South Carolina Signs KCPA Into Law

South Carolina’s KCPA went into effect, requiring retailers to keep kratom products in locked display cases and setting limits on synthetic alkaloid content — a model for responsible regulation.

June 2025
Connecticut Governor Signs HB6855

In a disappointing development, Connecticut’s governor signed a bill that designated kratom and its derivatives — including 7-OH — as Schedule I substances. Enforcement began in February 2026.

July 2025
Rhode Island Reverses Its Ban 🎉

In a historic first, Rhode Island passed legislation to reverse its kratom ban and transition to a regulated framework. The new rules take effect April 1, 2026 — making it the first state to reverse course on a kratom prohibition.

July 2025
HHS Recommends 7-OH Scheduling

The HHS emergency scheduling recommendation placed synthetic 7-hydroxymitragynine firmly in Schedule I at the federal level. This targets synthetic derivatives — not natural kratom — but it has accelerated state-level action on 7-OH products.

August 2025
Louisiana Ban Takes Effect

Louisiana’s SB 154 went into effect, making it the 6th state to fully prohibit kratom. The law reclassified key kratom alkaloids as Schedule I substances with penalties up to 5 years imprisonment. Phytoextractum can no longer ship to Louisiana addresses.

December 2025
Ohio Issues Emergency Kratom Rule

Ohio’s Board of Pharmacy issued an emergency rule banning most kratom products except those composed solely of pure mitragynine. The 180-day window for permanent rulemaking is underway.

March 2026
Spokane, WA Enacts City-Level Ban

The city of Spokane, Washington enacted a local ban on kratom sales — a reminder that even in legal states, local jurisdictions can impose their own restrictions.

April 2026
Tennessee Signs Full Kratom Ban

Governor Lee signed HB1649 (“Matthew Davenport’s Law”), making Tennessee the 8th state to fully prohibit kratom. The law bans all kratom products — natural leaf and 7-OH alike — effective July 1, 2026. Possession becomes a Class A misdemeanor and sale a Class C felony. Phytoextractum will no longer be able to ship to Tennessee addresses once the ban takes effect.

What’s Happening with 7-OH?

One of the biggest developments in 2025 was the wave of action around 7-hydroxymitragynine (7-OH), a concentrated kratom derivative. Here’s the key context:

✅ Federal Status Kratom itself remains unscheduled and legal at the federal level as of March 2026. The HHS scheduling recommendation specifically targets synthetic 7-OH — not natural kratom leaf or traditional kratom products.

At Phytoextractum, we have never sold or supported synthetic 7-OH products. We believe the distinction between natural kratom and synthetic derivatives is critically important, and we support sensible regulation that protects consumers while preserving access to natural, lab-tested kratom.

States that have independently restricted or banned 7-OH products include: Louisiana, Connecticut, Mississippi, Colorado, Florida, Ohio, Tennessee, and South Carolina — though in many of these states, natural kratom remains fully legal and accessible.

Why Advocacy Matters More Than Ever

If the timeline above makes one thing clear, it’s that nothing is settled. States are moving in both directions — some passing protections (Mississippi, South Carolina, Rhode Island) while others advance new bans (Connecticut, Tennessee, Michigan). The outcome often depends on whether informed voices show up to the conversation.

Here’s what you can do:

💬 Contact Your Reps
State legislators vote on kratom bills. A personal call or email from a constituent makes a real difference — especially when bills are in committee.
📜 Support the KCPA
The Kratom Consumer Protection Act creates a responsible framework: age restrictions, lab testing requirements, and labeling standards. It’s the opposite of an unregulated free-for-all.
🤝 Join the AKA
The American Kratom Association coordinates advocacy efforts nationwide. They track bills, mobilize supporters, and provide resources for testimony and public comment.

20 Years of Trust: Phytoextractum’s Journey

October 15, 2025 by Phyto

In 2005, Phytoextractum was born out of a passion for botanical discovery and a vision for a better future for kratom. At the time, few had even heard of kratom, and the idea of an online vendor dedicated to this remarkable plant was revolutionary. Fast-forward 20 years, and we are proud to stand as one of the longest-running, most trusted names in the kratom industry.

Our journey has been anything but simple. From the early days of explaining what kratom even was, to the turbulence of FDA and DEA scrutiny, to today’s more established—but still evolving—market, we have remained committed to our core values: integrity, quality, and community.

From Family Startup to Industry Leader

What began as a small family operation in Portland has since grown into a robust company with over 20 employees and a full-scale warehouse. Our team is made up of eclectic and passionate individuals who reflect the unique, vibrant culture of Portland itself. Each member brings something different to the table, but we are united by a shared mission: to provide the kratom community with products we ourselves would proudly use.

This growth wasn’t just about expanding operations—it was about creating something sustainable, trustworthy, and enduring in an industry that has faced more than its fair share of challenges.

Standing Strong Through Industry Challenges

The kratom world has seen its highs and lows. We’ve been there through every chapter:

  • 2005–2010: Introducing kratom to an online audience and building trust one customer at a time.
  • 2010–2015: Supporting advocacy efforts, including major donations to the American Kratom Association and botanical research initiatives.
  • 2015–2020: Weathering regulatory storms and standing firm in the face of attempted bans.
  • 2020–2025: Expanding responsibly while continuing to serve a passionate and growing community.

Every challenge strengthened our resolve. Every victory reaffirmed our belief in kratom’s potential to change lives.

Advocacy and Community Support

From the very beginning, advocacy has been central to who we are. We’ve proudly supported the American Kratom Association (AKA) and other botanical initiatives, helping ensure that kratom remains available and safe for responsible adults.

But advocacy goes beyond policy—it’s about people. It’s about making sure the voices of kratom consumers are heard, and that this community is represented fairly and honestly.

Gratitude for Our Customers

None of this would have been possible without you. Some of our customers have been with us since the very beginning—20 years of loyalty, trust, and shared passion for kratom. To you, and to every single person who has joined us along the way, we owe our deepest thanks.

Your support has allowed us to grow, to fight for kratom, and to continue offering the products you love. You are not just customers—you are part of the Phytoextractum family.

Looking Ahead

As we celebrate 20 years, we’re not just looking back—we’re looking forward. Our commitment to innovation, integrity, and community remains stronger than ever. The future of kratom is bright, and we are honored to continue leading the way with you by our side.

Here’s to the next 20 years.

HHS Bans 7OH: A Win for Safe, Natural Kratom

July 29, 2025 by Phyto

The HHS emergency scheduling of 7-hydroxymitragynine (7OH) places this synthetic compound firmly in Schedule 1, effectively banning its sale, possession, and use in the U.S.

This move targets potent synthetic derivatives, not natural Kratom, but it’s a reminder of how vital it is to differentiate the two.

Why This Matters

We believe this is a necessary and positive step for the Kratom industry. At Phytoextractum, we have never sold or supported 7OH products, which run counter to our commitment to safe, natural botanicals.

Banning 7OH draws a line between natural Kratom and manipulated synthetics—a distinction critical to protecting responsible consumers and preventing unnecessary crackdowns on legitimate Kratom.

Our Natural Extract Promise

All Phytoextractum Kratom extracts and enhanced products are made exclusively from natural Kratom leaves or powders. Unlike synthetic derivatives such as 7OH, our extracts are crafted using traditional, plant-based methods that preserve the natural integrity of Kratom. Every product is rigorously tested in certified laboratories for purity, potency, and contaminants, ensuring you receive only the highest-quality, safest options available. Responsibly sourced from trusted growers and fully compliant with industry standards, our extracts offer a clean, consistent experience you can feel confident about.

The Road Ahead

While we support this scheduling, we remain vigilant. The fight to protect natural Kratom continues, and it’s essential to advocate for sensible regulation, not prohibition. This action by HHS also reinforces the need for consumers to choose reputable vendors who prioritize transparency and safety. At Phytoextractum, every product we sell is derived from 100% natural Kratom leaves and undergoes rigorous third-party lab testing to verify purity and potency. By avoiding synthetic derivatives like 7OH and focusing solely on natural Kratom, we’re proud to provide safe, high-quality products that align with responsible use and industry best practices.

Last Chance: Louisiana Kratom Ban on 8/1

July 28, 2025 by Phyto

The countdown is on: Louisiana’s full Kratom ban takes effect on August 1, 2025. This means Louisiana residents have only a few days left to make their final Kratom purchases before the law prohibits sales and possession across the state.

If you’re in Louisiana, this is your last opportunity to prepare. Once the ban begins, we will no longer be able to ship Kratom to Louisiana addresses.

🌱 We’re Committed to Kratom Advocacy

This ban is a setback, but it’s also a reminder of why advocacy matters. Phytoextractum is dedicated to working alongside groups like the American Kratom Association (AKA) to fight misinformation and push for science-backed regulation that protects consumers rather than prohibiting access.

You can help by:

  • • Supporting the Kratom Consumer Protection Act in your state.
  • • Sharing your story with legislators to show the positive impact of Kratom.
  • • Joining organizations dedicated to preserving access to natural botanicals.

Connecticut’s HB6855 Aims to Ban Kratom

June 5, 2025 by Phyto

A late-session amendment to Connecticut’s HB6855 — originally a hemp regulation bill — now threatens to classify kratom as a controlled substance, effectively banning access to the botanical across the state. The amended bill passed both chambers in just two days and now awaits Governor Ned Lamont’s signature.

The proposed language allows kratom to be scheduled “in the appropriate schedule,” a vague phrase that opens the door to extreme classification. Should kratom be added as a Schedule I substance, it would be treated the same as drugs like heroin or LSD, despite a lack of scientific evidence supporting such a designation. Even as a Schedule II or III drug, consumer access would be severely restricted.

Scientific Community and Advocates Push Back

Kratom is a natural plant with a centuries-long history of traditional use and growing support from researchers, healthcare practitioners, and millions of American consumers. Recent studies, including an FDA-led human tolerance study, demonstrate kratom’s relatively low risk profile. Neither the DEA nor the World Health Organization has recommended scheduling the plant, citing a lack of evidence of widespread harm.

Organizations like the Global Kratom Coalition and the American Kratom Association are urging the governor to veto the bill. In testimony, GKC’s Legislative Director, Walker Gallman, noted that kratom’s inclusion in HB6855 unjustly equates it with synthetic substances like tianeptine and phenibut, which carry significantly different risk profiles.

Our Role in Advocacy

At Phytoextractum, we’re deeply committed to the safe, responsible future of kratom. Through direct support of advocacy organizations, education campaigns, and legislative outreach, we are doing everything in our power to preserve consumer access and promote evidence-based regulation — not fear-driven prohibition. We stand in firm opposition to HB6855 and any legislation that ignores the science in favor of political expedience.

Take Action Now

If you live in Connecticut or care about kratom’s future, we encourage you to contact Governor Ned Lamont today and respectfully urge a veto of HB6855.

📞 Call: 860-566-4840 (Press 1)
📧 Email: Governor Lamont’s Contact Form

Let’s keep kratom accessible, safe, and grounded in science — not stigma.

Kratom Ban Passes in Louisiana: Your Voice Is Needed

May 28, 2025 by Phyto

In a deeply concerning turn of events for Kratom supporters, Louisiana lawmakers have approved a bill that would fully ban the sale, possession, and use of Kratom throughout the state. With commanding majorities in both chambers—86–6 in the House and 26–11 in the Senate—the bill now heads to Governor Jeff Landry’s desk for final approval.

This means Louisiana is just one step away from becoming the next state to prohibit Kratom entirely. Unless Governor Landry vetoes or delays the bill, it could be signed into law within days.

Why the Rush to Ban Kratom?

“We are losing our babies. We are losing our children.”
— Rep. Debbie Villio (R-Kenner)

Bill supporters, such as Rep. Debbie Villio and Sen. Jay Morris, claim that Kratom is dangerous, addictive, and marketed irresponsibly. Villio referred to the botanical as “gas station heroin” and criticized vendors for making what she alleged are misleading health-related statements. She pushed for swift passage of the ban, citing public health concerns—despite a lack of conclusive evidence or regulatory oversight from federal agencies.

Meanwhile, Rep. Peter Egan (R-Covington) pushed back, highlighting the responsible use of Kratom by over 300,000 Louisiana residents, many of whom rely on the natural leaf for everyday wellness and quality of life. He proposed amendments to preserve access to pure, unaltered Kratom—but these were ultimately rejected.

“People who use the natural leaf just want to function, to feel okay. That’s all.”
— Rep. Peter Egan

The Broader Implications: Industry at a Crossroads

The last time we saw a state try to pass an outright ban on Kratom was back in 2017. Since then, the Kratom community has made great strides by working with lawmakers to develop thoughtful regulation through initiatives like the Kratom Consumer Protection Act (KCPA). The Louisiana ban threatens to undo that progress.

This is no longer a local issue—it’s a national one. If this bill is enacted, it could ignite similar efforts in other states. The Kratom community cannot afford to stay silent. Every voice counts in the ongoing fight to protect access to safe, lab-tested Kratom.

What’s even more troubling is that Senator Jay Morris, the architect behind this bill, has accepted notable contributions from pharmaceutical lobbying groups. These groups have historically opposed Kratom and other natural supplements that could disrupt their market share. It’s important to recognize the potential conflict of interest and question whose interests this legislation truly serves.

How You Can Help: Take Immediate Action

Your voice could help turn the tide. Governor Landry still has the power to reject this bill or send it back for revisions. Now is the time to let him—and your state legislators—know how important Kratom is to you and your family.
